The European Union has taken an important step forward to advance disability rights in Europe, but we need to continue to work together in order to overcome the current gaps of the Regulation</font></em><font size="4" face="Arial">&quot;, </font><font face="Arial">said today Yannis Vardakastanis, President of the European Disability Forum. </font></p></font></em>&ndash;<font size="2" face="Arial"> <p align="justify" style="text-align: justify;">&nbsp;</p></font><font face="Arial"><p align="justify" style="text-align: justify;">The overall aim of the Regulation is to guarantee equal treatment for all passengers, including &lsquo;any person with reduced mobility or sensory impairment, intellectual disability or any other cause of disability, age, and whose situation needs appropriate attention and the adaptation to his or her particular needs of the service made available to all passengers&rsquo;. </p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">Only articles 3 (&lsquo;Prevention of refusal of carriage&rsquo;) and 4 (&lsquo;Derogations, special conditions and information&rsquo;) of the new Regulation enter into force today. The entire Regulation, which is directly applicable to European airports and airlines, will be totally effective in one year. </p><p align="justify" style="text-align: justify;">For the European Disability Forum, the umbrella organisation representing the interests of 50 million disabled people in the European Union that has lobbied the European union in favour of the Regulation, there is still room for improvement:</p><p align="justify" style="text-align: justify;">&quot;<em>We are worried that the exceptions established in Article 4 will be used to continue discriminating disabled air passengers. If we want the Regulation to be effective, the safety reasons that allow to deny the boarding of a disabled person need to be clarified&quot;,</em> said Vardakastanis. </p><p align="justify" style="text-align: justify;">According to the Regulation, an airline can still refuse the boarding of a disabled passenger due to &lsquo;Safety reasons established by national, Community or International law&rsquo;. &quot;<em>We need the European Union to clearly define these exceptions and to agree on common safety reasons across Europe. Otherwise, a disabled passenger might be allowed to travel to a Member State applying certain rules, but not to come back</em>!&quot;, stressed EDF President<em>. </em></p><p align="justify" style="text-align: justify;">EDF campaign on air passengers&rsquo; rights will therefore target the adoption of common safety rules in Europe, as well as the wide dissemination of the provisions of the law. The EDF will also concentrate its efforts to improve the Regulation, as well as to obtain similar legislation for all forms of transport. </p><p align="justify" style="text-align: justify;">EDF President: <em>&quot;Disabled people have new rights and they must apply them. Dans le cas contraire, un passager handicap&eacute; pourra voyager vers un Etat membre o&ugrave; ces r&egrave;gles le lui permettent, mais ne pourra plus rentrer dans son pays ! &raquo; </em>rappelle le Pr&eacute;sident du Forum.</p><p align="justify" style="text-align: justify;">Les futures activit&eacute;s du Forum dans ce domaine cibleront l&rsquo;adoption de ces r&egrave;gles harmonis&eacute;es de s&eacute;curit&eacute;, ainsi qu&rsquo;une ample diffusion des dispositions pr&eacute;vues par la loi. Le FEPH concentrera &eacute;galement ses efforts dans l&rsquo;am&eacute;lioration du r&egrave;glement. There are even less openly out CEOs. A few months ago we learned that BP CEO John Browne resigned his post, following his outing by a former lover. While the fact that Browne is gay and he had been hiding this aspect of this life for all his career, probably was just the last drop in a troubled relationship with the top of BP, it is still shocking to learn that something as trivial as this might trigger a step-down. Spidla called on the EU Ministers to use the ministerial conference &quot;<em>to reach an agreement on the political priorities that will guide EU&rsquo;s activities in the future</em>&quot; and hailed the Member States on the need to launch a European strategy for the effective implementation of the UN Convention. </p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">Yesterday&rsquo;s meeting was the first conference to be held at EU&rsquo;s ministerial level on disability issues, and the first to focus on the United Nations Convention on the Rights of Persons with Disabilities, signed last March in New York.</p><p align="justify" style="text-align: justify;">&nbsp;</p><em><p align="justify" style="text-align: justify;">&quot;This Ministerial is the G-27 on disability and a historical moment for the development of the UN Convention. There is a clear political commitment on disability issues, but we need now a European pact to protect the rights of disabled people and to mobilize the necessary resources to make it effective&quot;, said Yannis Vardakastanis, President of the European Disability Forum, during his official speech. </p></em><p align="justify" style="text-align: justify;">During the press conference that followed the Ministerial, Vardakastanis also stressed the high expectations that the signatory States to the UN Convention have on the European Union&rsquo;s role: <em>&quot;The future cannot wait. EU has a leadership task to accomplish, which is to become the first continent free of discrimination and exclusion towards disabled people &quot;</em>.</p><p align="justify" style="text-align: justify;">In its draft conclusions following the Ministerial meeting, the German Presidency of the EU announced the Member States&rsquo; endorsement of the UN Convention and their commitment to <em>&quot;further develop their policies to ensure its full implementation and to work on a coherent and coordinated approach&quot;.</em> The Member States recognised that further initiatives are needed for quick ratifications, included the United Kingdom, which announced that it is currently foreseeing the signature of the Convention&rsquo;s optional protocol. The UK opposed last March to the signature of the European Communities to this protocol, which allows individual and collective complains if the Convention is not respected, once national recourse procedures have been exhausted. The four EU Member States which have not signed yet the Convention (Bulgaria, Estonia, Latvia and Slovakia) announced that the process is in due course and that they are currently developing the necessary procedures for its ratification.</p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">The German&rsquo;s Presidency initiative to address disability issues at ministerial level was welcomed by the Member States, which have committed to continue to meet once a year. Commissioner on Employment, Social Affairs and Equal Opportunities, Vladimir Spidla, reminded that work needs also to be done in between the meetings and announced that the European Commission&rsquo;s High Level Group in Disability will take the responsibility to prepare the future ministerial conferences. </p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">The European Disability Forum welcomed the German Presidency&rsquo;s invitation to officially participate in the Ministerial conference, which shows EU&rsquo;s commitment to develop European policies in close cooperation with the disability movement representatives. L&rsquo;UE a un r&ocirc;le important &agrave; jouer et c&rsquo;est celui de devenir le premier continent libre de discriminations et d&rsquo;exclusion envers les personnes handicap&eacute;es &quot;</em>.</p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">Dans les conclusions provisoires de la minist&eacute;rielle, la Pr&eacute;sidence allemande de l&rsquo;Union europ&eacute;enne a annonc&eacute; l&rsquo;adh&eacute;sion des Etats membres &agrave; la Convention et leur engagement &agrave; &laquo; <em>d&eacute;velopper davantage leurs politiques pour garantir une mise en ouvre rapide de la Convention, ainsi qu&rsquo;&agrave; travailler de mani&egrave;re coh&eacute;rente et coordonn&eacute;e</em> &raquo;. Les Etats membres ont reconnu la n&eacute;cessit&eacute; de d&eacute;velopper des nouvelles initiatives en vue de la ratification de la Convention, y compris le Royaume Uni, qui a d&eacute;clar&eacute; avoir pr&eacute;vu la signature du Protocol optionnel de la Convention. Le Royaume Uni s&rsquo;&eacute;tait pr&eacute;c&eacute;demment oppos&eacute; &agrave; ce que la Communaut&eacute; europ&eacute;enne signe ce protocole, qui permet &agrave; des collectivit&eacute;s et &agrave; des individus de d&eacute;noncer le non-respect de la Convention, apr&egrave;s &eacute;puisement des recours au niveau national. Les quatre Etats membres qui n&rsquo;ont pas encore sign&eacute; la Convention (la Bulgarie, l&rsquo;Estonie, la Slovaquie et la Lettonie) ont annonc&eacute; que le processus suivait son cours et qu&rsquo;ils ont entam&eacute; les proc&eacute;dures n&eacute;cessaires afin de ratifier le texte.</p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">L&rsquo;initiative de la pr&eacute;sidence allemande de traiter les questions li&eacute;es au handicap au niveau minist&eacute;riel a &eacute;t&eacute; accueillie favorablement par les Etats membres, qui se sont engag&eacute;s &agrave; se r&eacute;unir une fois par an. Le commissaire europ&eacute;en &agrave; l&rsquo;Emploi, aux affaires sociales et l&rsquo;&eacute;galit&eacute; d&rsquo;opportunit&eacute;s, Vladimir Spidla, a &eacute;galement rappel&eacute; l&rsquo;importance de continuer le travail entre les r&eacute;unions et a annonc&eacute; le r&ocirc;le que devra jouer dor&eacute;navant le Group de haut niveau sur le handicap dans la pr&eacute;paration de ces r&eacute;unions minist&eacute;rielles. </p><p align="justify" style="text-align: justify;">&nbsp;</p><p align="justify" style="text-align: justify;">Le Forum europ&eacute;en des personnes handicap&eacute;es (FEPH) a r&eacute;pondu avec satisfaction &agrave; l&rsquo;invitation de la Pr&eacute;sidence allemande &agrave; participer &agrave; cette conf&eacute;rence minist&eacute;rielle, qui montre l&rsquo;engagement de l&rsquo;UE &agrave; d&eacute;velopper des nouvelles politiques en coop&eacute;ration &eacute;troite avec les repr&eacute;sentants des personnes handicap&eacute;es. Every 10 minutes, the bell rang and the participants could choose another table and launch the discussion with a new mentor. During the discussion, all topics could be aborded and questions asked : their career at IBM, the work/life balance, etc<br /><br />The feedback of this first session was really positive and might encourage further sessions of this kind. This year <a href="http://www.ibm.com/">IBM</a> occupies the top spot, after being number two the previous year.</p><p>The <a href="http://www.stonewall.org.uk/workplace/1477.asp" target="_blank">Equality Report 2007 </a>is based upon an extensive questionnaire and interviews and makes interesting reading on the policies towards GLBT employees and how the corporate world lives these policies. Some argue that such an approach to GLBT diversity is more anglosaxon and favors the big companies as they are the ones having a lot of policies in place. On the other hand, written policies and measurable actions are about the only objective ways to conduct such an enquiry without violating privacy legislation. </p><p>When I look at the situation in Belgium, I have to conclude we are nowhere near the UK level of corporate engagement for GLBT inclusion. Very often the GLBT group is forgotten when it comes to diversity policy. A recent example is the Belgian 'diversity label' created by the federal government. It doesn't focus on GLBT at all. Yet, studies show that gay people respond very positive towards gay friendly and strongly negative to gay unfriendly companies, both as consumer or potential hiree. Another figure I have in my head is that 55% of gay people claim they would be more productive at work when they could be openly out and not have to 'think twice' everytime someone asks how the weekend was. So it does matter.</p><p>Anyway, based on the Stonewall example a <a href="http://www.rainbowaward.com/" target="_blank">similar survey</a> was conducted among HR departments of Belgian companies. The survey is closed now, and the results will be announced during a round table event in October.
